BetterWorld Accelerator Program Terms and Conditions

These Terms and Conditions (“Terms”) constitute a legally binding agreement between you (“Participant”, “you”, or “your”) and BetterWorld, Inc. (“BetterWorld,” “we,” “us,” or “our”) governing your participation in the BetterWorld Accelerator Program (the “Program”).


1. Program Overview

The BetterWorld Accelerator Program is a three (3) year fundraising growth initiative designed to support qualified nonprofit organizations in maximizing their impact using BetterWorld’s fundraising tools and strategic services. Subject to full compliance with these Terms, if the Participant’s total qualifying fundraising revenue over the Program Period does not exceed the revenue from the preceding three (3) years, BetterWorld shall:

  • Refund all Program fees paid by the Participant; and

  • Make a charitable donation to the Participant’s organization, the amount of which shall be determined based on the Participant’s enrollment tier at the time of acceptance into the Program.

This guarantee is subject to the eligibility, participation, documentation, and performance requirements detailed below.

2. Eligibility Requirements

To be eligible for Program enrollment and the associated guarantee, the Participant must, as of the Effective Date:

  • Be a registered and active 501(c)(3) nonprofit organization (or equivalent status under applicable law);

  • Have been in continuous operation for a minimum of two (2) years prior to enrollment, unless otherwise approved in writing by BetterWorld;

  • Demonstrate a minimum of $50,000 in annual individual donation revenue, unless explicitly waived in writing by BetterWorld; and

  • Complete and submit all enrollment materials and fee payments as required by BetterWorld.

3. Program Fees

Program fees shall be based on the average gross fundraising revenue reported on the Participant’s two most recent IRS Form 990 filings or equivalent financial records. Fee tiers and structures are determined at the time of enrollment and shall remain fixed for the duration of the Program Period, regardless of any changes in the Participant’s fundraising revenue. BetterWorld reserves the right to verify the accuracy of reported fundraising data through reasonable documentation requests.

4. Program Benefits

Participants will receive access to the following Program services and resources:

  • A comprehensive onboarding and strategic planning session;

  • A monthly Accelerator Insider newsletter with curated best practices;

  • Quarterly Accelerator-only webinars featuring advanced strategies;

  • Two (2) annual personalized strategic reviews;

  • Quarterly market insight briefings and thought leadership content;

  • Priority access to BetterWorld’s customer support.

5. Guarantee Requirements

To maintain eligibility for the refund and donation guarantee, the Participant must, for the entire Program Period:

  1. Participation Commitment:
    Remain continuously enrolled and in good standing for the full three (3) years of the Program Period.

  2. Platform Usage:

    • Transition to and utilize BetterWorld donation forms (embedded, pop-up, or linked) as the primary method of online donation collection within six (6) months of enrollment.

    • Use BetterWorld’s platform for a majority of all fundraising campaigns conducted during the Program Period, measured by both (a) the number of campaigns and (b) total donation volume.

  3. Fundraising Activity Consistency:
    Conduct a number of fundraising campaigns (e.g., galas, auctions, peer-to-peer, online events) during the Program Period that is at least equal to the number conducted during the three (3) years immediately preceding enrollment.

  4. Engagement Requirements:

    • Participate in at least one (1) strategic review meeting per calendar year;

    • Provide, upon request, any documentation reasonably required to confirm compliance with these Terms.

6. Guarantee Claim & Payout

If, at the end of the Program Period, the Participant meets all requirements under Sections 2 and 5, and the total qualifying fundraising revenue over the three-year Program Period is less than the total qualifying revenue over the immediately preceding three-year period, then:

  • BetterWorld will refund 100% of Program fees paid; and

  • Make a charitable donation to the Participant’s organization in an amount determined by the enrollment tier.

Claims Process:

All guarantee claims must be submitted in writing to BetterWorld within ninety (90) calendar days following the conclusion of the Program Period. The claim must include all relevant documentation, including but not limited to historical fundraising data, campaign logs, and donation records.

BetterWorld reserves the right to audit the claim and may request additional documentation to verify compliance.

7. Exclusions from Revenue Calculation

The following categories of funds are expressly excluded from both baseline and Program Period revenue calculations:

  • Capital campaign contributions

  • Government grants or contracts

  • Institutional or foundation grants

  • The top three (3) individual donations received per calendar year

  • Cryptocurrency, stocks, wire transfers, and legacy gifts (including bequests and trusts)

8. Cancellation & Early Termination

  • The Participant may voluntarily cancel enrollment at any time by providing written notice to BetterWorld.

  • Participants who do not complete the full three-year Program Period are not eligible for a refund or guarantee donation.

  • If the Participant organization ceases operations, dissolves, or becomes ineligible under Section 2 during the Program Period, the guarantee shall be voided and no refund or donation will be issued.

9. Promotional Discounts

Participants may be offered discounts through promotional partnerships, affiliate programs, or time-limited offers. Receipt of such discounts does not impact guarantee eligibility, provided all other conditions herein are met.

10. Program Fund Stewardship

All Program fees will be maintained in a designated interest-bearing account during the Program Period. The account may be commingled with other BetterWorld funds but will be used solely to fulfill the obligations of this Program.

11. Modifications

BetterWorld may amend these Terms, Program benefits, or requirements at any time. Material changes will be communicated to Participants in writing at least thirty (30) days prior to becoming effective. Continued participation constitutes acceptance of any such changes.

12. Limitation of Liability

To the fullest extent permitted by law, BetterWorld shall not be liable for any indirect, incidental, punitive, special, or consequential damages arising out of or related to participation in the Program. In all cases, BetterWorld’s aggregate liability shall not exceed the total Program fees paid by the Participant.

13. Governing Law

These Terms shall be governed by and construed under the laws of the State of Delaware, without regard to its conflict of law principles. Any disputes arising from these Terms shall be brought exclusively in the state or federal courts located in Delaware.
